swislmall is a multi-vendor marketplace that connects buyers with independent sellers ("Vendors"). swislmall acts as a platform provider and is not party to any transaction between customers and vendors. Each vendor is solely responsible for the products they list, their quality, legality, and fulfilment.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and password. You must notify us immediately at info@smartworldfashion.top if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these terms.
Vendors must: (a) provide accurate product descriptions, images and pricing; (b) fulfil orders promptly and as described; (c) comply with all applicable laws and regulations; (d) not sell counterfeit, illegal, or prohibited items; (e) respond to customer enquiries within a reasonable time. swislmall reserves the right to remove any vendor or product without notice.
All transactions are processed through approved payment gateways. swislmall charges a commission on each sale as agreed with the vendor. Payouts are processed by the platform administrator. swislmall is not responsible for payment gateway failures or delays caused by third-party processors.
You may not: (a) use the Platform for any unlawful purpose; (b) post false, misleading, or fraudulent listings; (c) harass, abuse, or harm other users; (d) attempt to bypass payment systems; (e) scrape or copy platform content without permission; (f) impersonate another person or entity; (g) upload malware or harmful code.
swislmall and its underlying software platform are proprietary. The platform software is developed and owned by its creators and may not be copied, redistributed, resold, or sublicensed without express written permission. User-uploaded content remains the property of the respective users. By uploading content, you grant swislmall a licence to display it on the Platform.
The Platform is provided "as is" without warranties of any kind. swislmall does not guarantee uninterrupted access, error-free operation, or the accuracy of vendor listings. We are not responsible for any loss arising from your use of the Platform or transactions with vendors.
To the maximum extent permitted by law, swislmall shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including lost profits, data loss, or business interruption.
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these terms. By using the Platform you consent to the practices described in our Privacy Policy.
We may update these terms from time to time. We will notify users of material changes by posting a notice on the Platform. Continued use after changes constitutes acceptance of the new terms.
These terms are governed by the laws of Kenya. Any disputes shall be resolved through the courts of Kenya or by mutual agreement through mediation.
